We have some good news regarding our efforts to challenge DOC's new N95 respirator policy.
The Public Employment Relations Commission (PERC) has issued a preliminary ruling, moving our Unfair Labor Practice (ULP) charge in the case on for further processing. This is an important procedural step indicating that PERC is prepared to more thoroughly consider the case.
With PERC's preliminary ruling, DOC must now respond to our complaint within 21 days.
Our argument is that the DOC violated State labor law by not fulfilling its statutory obligation to negotiate with the Union over a change in working conditions when it issued the new policy.
