Local 117’s legal team has succeeded in securing an additional day of annual leave for Teamsters at the DOC whose rights were violated in an arbitration case involving personal holidays.
The case arose in 2011 when the Department of Corrections began engaging in the practice of denying personal holiday requests under the pretext that “relief was unavailable.” Nearly 400 members are known to have had a personal holiday request denied in 2011, but there are likely more.
Local 117 challenged the Department’s practice and ultimately achieved an arbitration ruling in the Union’s favor that prevents the DOC from denying personal holiday requests based on a lack of available relief.

As a remedy for the arbitration win, your Union has achieved an agreement that provides that every eligible member who was denied a personal holiday in 2011 will be granted an additional day of annual leave. This includes those members who, after being denied their personal holiday, took a different personal holiday in 2011 and those who carried their personal holiday over into 2012.
IMPORTANT: If you work at the Department of Corrections and were denied a personal holiday in 2011 and took a different personal holiday last year, you must come forward and claim the remedy by being able to show the denial. You must present your claim within two weeks of receiving notice from the DOC. All other members who were denied a personal holiday in 2011 will have the additional annual leave automatically added to their bank.
This is a great win for Teamsters at the DOC. It demonstrates the strength of your collective bargaining agreement and it shows that your Union will vigorously defend your rights when they are violated.

If your name does not appear on the spreadsheet and you believe you properly submitted a timely request for your personal holiday in 2011, and that request was improperly denied, submit evidence of the denied request (such as the denied leave slip) to PHDenials@doc1.wa.gov.
